Welcome to MuseToon (the “Platform” or “MuseToon”). The Platform is provided and controlled by the MuseToon Team (“we” or “us”). This Terms of Service (this “Terms”) governs your usage of our AI comic creator services. By using or accessing MuseToon, you agree to be bound by these Terms.

The Terms are written in English (US). If you do not accept and agree to the Terms, you must not access or use the application.

1. SPECIAL NOTICES

1.1 You may only use our Service if you are 18 years or older, and if you are not subject to statutory age limits in your country. Guardians of users under 18 must provide valid consent before their wards can use our platform.

1.2 You shall be solely responsible for the safekeeping of your MuseToon credentials. All activities conducted through your authenticated account (such as Google or Apple ID) will be deemed as your own behaviors.

2. SERVICES CONTENT & BILLING RULES

2.1 MuseToon offers both free features and paid-for premium features (such as Diamonds and VIP memberships). Access to premium features requires successful payment of relevant charges.

2.2 Virtual Diamonds: Diamonds are virtual computing tokens used exclusively to purchase AI image generation capacity. Diamonds have no cash value, are non-transferable, and all purchases are final and strictly non-refundable. Chargeback abuse will result in immediate account termination.

2.3 VIP Subscription: VIP packages grant exclusive styles, text decorations, or prompt allocations during the active period. Auto-renewals are managed directly via Apple App Store or Google Play Store billing systems. You can cancel auto-renewals anytime via platform settings, but no refunds will be issued for active subscription periods.

3. CONTENT POLICY & PROHIBITED UGC

3.1 You retain ownership of specific narrative layouts and text descriptions you submit. However, by uploading content, you grant MuseToon a worldwide, non-exclusive, royalty-free license to host, process, and transcode your materials for the purpose of operating the Service.

3.2 Prohibited Content: You strictly agree NOT to write prompts, generate, or publish any User Generated Content (UGC) that:

• Is sexually explicit, pornographic, or obscene;
• Depicts, promotes, or encourages violence, self-harm, or graphic mutilation;
• Encourages illegal acts, hate speech, terrorism, or violent extremism;
• Infringes copyrights, trademarks, patents, or proprietary rights of third parties.

3.3 Moderation: We employ automated AI filters and manual reviews to scan input prompts and outputs. If a violation is detected, we reserve the right to delete the content, freeze outstanding Virtual Diamonds, and permanently terminate the account without warning or refund.

4. LIABILITY LIMITATIONS & WARRANTY DISCLAIMER

4.1 MuseToon is provided on an "as is" and "as available" basis. We make no warranties, statutory, express, or implied, regarding the AI generation output quality, accuracy, non-infringement, or availability of server endpoints.

4.2 To the maximum extent permitted by applicable law, MuseToon's total aggregate liability for all claims arising out of the Service shall not exceed the amount of USD 200.

5. LEGAL JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (“HKIAC”) in accordance with its Arbitration Rules. The seat of arbitration shall be Hong Kong, and the language of arbitration shall be English.
